(hereinafter referred to as "AGENCY") 1. AGENCY shall provide CLIENT with investigative services which may result in: written reports; recorded statements; various documents and/or other documentation; as well as photographic, video, audio, and related materials, as set forth by the terms and conditions below. 2. AGENCY reserves the right to decline, or withdraw from, any assignment that might give rise to a conflict without explanation. 3. CLIENT will furnish AGENCY with true and accurate information to the best of CLIENTS knowledge and ability at the time of this agreement. 4. CLIENT understands and agrees that knowingly supplying false, misleading or incomplete statements or information to AGENCY relating to said assignment will result in immediate termination of said assignment and forfeiture of all retainers and money paid to AGENCY. 5. AGENCY does not draw conclusions, makes representations, nor expresses any opinions regarding the information contained in Investigative reports. 6. CLIENT acknowledges that the information contained in such reports is obtained from sources including, but not limited to: public records, commercial databases, nonproprietary services and through observation or perception, which may require the exercise of judgment of interpretation. Name similarities may be included in public records, Investigative reports and commercial databases, due to lack of sufficient information to verify that the individual or entity is the subject of research. 7. CLIENT agrees that all reports will be submitted and received subject to the conditions of this Agreement. 8. By requesting and receiving reports, the CLIENT agrees to indemnify and hold harmless AGENCY, its officers, and employees from any and all claims, liabilities, expenses, fees including attorney fees, costs, and judgments arising from CLIENTS use or possession of the information furnished in said reports. 4. Reports may be delivered via US Mail; faxed upon consent of CLIENT; delivered via US Mail; hand delivered and/or delivered telephonically. CLIENT requests a written report, ______ YES, _____ NO. 5. A RETAINER in the amount equal to 10 hours billing as defined below, is required to secure services. NO action will be initiated on any case, without an appropriate retainer. 6. Unless otherwise agreed by AGENCY in writing, CLIENT agrees to pay AGENCY for all work undertaken or to be undertaken at the rate of $__________ per hour billed, plus all associated expenses. X_______________________ 7. It is understood and agreed that all fees paid to AGENCY are considered earned upon receipt and not refundable. 8. CLIENT agrees to pay AGENCY for all services rendered, without regard to outcome. 9. It is further agreed that any and all court appearances pertaining to this case are billed at the rate of $150 (ONE HUNDRED AND FIFTY DOLLARS) per hour plus associated expenses. A portion of retainer may be held against anticipated court appearance charges. 4. Pursuant to Florida Statues Chapter 493.6119 (1), AGENCY will keep and maintain all reports strictly confidential, regardless of how delivered to client. Except where required by law, no information from reports will be revealed to ANY third party without CLIENT expressed written consent or upon order of Court of competent jurisdisction. 5. AGENCY will comply with all provisions of Federal, State, and Local laws and regulations pertaining to the use of information obtained during the course of assignment, and adhere to any and all current privacy rules and regulations. 6. CLIENT asserts and says all information obtained through the efforts of the AGENCY will be used for lawful purposes only. X____________________________________________ 7. CLIENT acknowledges that he/she has represented to the AGENCY a right to obtain information through a lawful investigation. X_______________________________________ CLIENT further releases AGENCY, its officers, employees, and affiliated companies and any companies or individual from which AGENCY obtains information included in a report, from the liability arising or alleged to arise directly or indirectly from any negligent acts, errors, or omissions by any of the providers of information or AGENCY in connection with the preparation of any reports, written or verbal.
